BANKRUPTCY & DEBT RELIEF

ILLINOIS BANKRUPTCY & DEBT RELIEF

Chapter 13 Bankruptcy Lawyer Serving Joliet & Illinois

A structured approach when you need time to address debt and keep important obligations on track.

How Chapter 13 works

Chapter 13 allows eligible individuals with regular income to propose a court-supervised plan. Plans generally last three to five years. What you must pay depends on income, allowable expenses, property, debt types, and legal requirements. There is no universal ten-percent minimum for general unsecured claims.

Mortgage arrears and keeping a home

A timely filing may pause foreclosure and allow eligible arrears to be addressed through a plan. Keeping the property generally also requires ongoing mortgage payments. Prior filings, sale timing, and other circumstances can limit relief; identify any scheduled sale at the start of the consultation.

A plan must work beyond the first month

A realistic budget matters. Gather evidence of income, housing costs, transportation, medical needs, support obligations, and other recurring expenses. Discuss likely changes instead of basing the plan on an unusually good month.

What to bring

  • Recent income records and tax information.
  • Mortgage arrears statements and foreclosure notices.
  • Vehicle loan details and other secured accounts.
  • Support and tax obligations.
  • Prior bankruptcy case information.

Chapter 13 questions

Are all my bills paid through one payment?

Not necessarily. Some obligations may be paid directly or have separate requirements. The proposed plan and applicable rules determine the treatment.

Will my payment equal my total debts divided by sixty?

No. That shortcut leaves out legal requirements and differences among debts. A proposed payment needs an individual calculation.

What if my income changes during a plan?

Contact your attorney promptly. Changes may require a review of the plan and possible court action.
