BANKRUPTCY & DEBT RELIEF

ILLINOIS BANKRUPTCY & DEBT RELIEF

How to Stop Wage Garnishment in Illinois

Start with the notice, your pay statements, and the next deadline.

Identify what is being collected

An ordinary judgment wage deduction is different from support withholding, tax collection, or other obligations. Read the notice and bring the complete document. The creditor, court, debt type, and date matter.

Illinois wage-deduction protections

For ordinary judgment deductions, Illinois law generally limits collection to the lesser of 15% of gross weekly wages or disposable weekly earnings above 45 times the greater applicable Illinois or federal minimum hourly wage. Other debt types can follow different rules. A current calculation requires the actual payroll and notice details.

Ask how bankruptcy may affect collection

A bankruptcy filing can stop many collection actions through the automatic stay. Exceptions and limitations apply, including situations involving prior cases or certain debts. A consultation alone does not stop collection; discuss timing and the exact notice with an attorney.

Bring these records

  • The summons, deduction order, and any employer notice.
  • Recent pay statements showing the amount withheld.
  • Case number, creditor information, and upcoming dates.
  • Any prior bankruptcy filing information.

Look beyond the deduction

A garnishment may be the immediate concern, but choosing a chapter requires the full financial picture. Review Chapter 7 eligibility and Chapter 13 repayment options.
